 End-User License Agreement ("Agreement")

Interpretation and Definitions

Interpretation

The words with capitalized initial letters have meanings defined under the following conditions. The definitions shall have the same meaning whether they appear in singular or in plural.

Definitions

For the purposes of this End-User License Agreement:

- Agreement means this End-User License Agreement that forms the entire agreement between You and the Company regarding the use of the Application.

- Application means the software program provided by the Company downloaded by You to a Device, named Phone Cleaner - Deep clean now.

- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Tilak Beladiya.

- Content refers to content such as photos, videos, contacts, files or other information stored on Your Device that the Application can access with Your permission.

- Country refers to: Gujarat, India.

- Device means any device that can access the Application such as an iPhone or iPad.

- Subscription means the auto-renewable premium plans offered inside the Application.

- Third-Party Services means any services or content provided by a third party (including advertisements) that may be displayed or made available by the Application.

- You means the individual using the Application or the company or legal entity on behalf of which such individual is using the Application.

Acknowledgment

By downloading or using the Application, You agree to be bound by the terms of this Agreement. If You do not agree, do not download or use the Application.

This Agreement is a legal document between You and the Company and governs Your use of the Application. The Application is licensed, not sold, to You by the Company for use strictly in accordance with this Agreement.

This Agreement is between You and the Company only, not Apple Inc. Apple is not responsible for the Application or its content. Apple has no obligation to provide maintenance or support for the Application. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against You.

License

Scope of License

The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application on Apple-branded devices that You own or control, strictly in accordance with this Agreement and the Usage Rules in the Apple Media Services Terms and Conditions.

This license is for Your personal, non-commercial use only.

Your Content and Deletion

The Application helps You find and remove duplicate or similar photos, videos, screenshots, large files and duplicate contacts, and compress media, using permissions You grant (such as Photos and Contacts access).

Your Content is processed on Your Device. The Company does not upload, sell or store Your photos, videos or contacts on its servers.

Items You delete may be moved to the iOS "Recently Deleted" album, from where they can be recovered for a limited time according to iOS settings. You are solely responsible for reviewing items before deleting them. The Company is not liable for any Content You choose to delete or merge.

Third-Party Services

The Application may display advertisements and include services from other providers (such as Google AdMob and Firebase).

You acknowledge that the Company is not responsible for the accuracy, legality, or functionality of any Third-Party Services. You use them at Your own risk and must follow any terms they provide.

Subscription Plans

The Application offers optional auto-renewable subscriptions that unlock premium features and remove advertisements:

- Weekly Plan

- Monthly Plan

The current price and length of each plan are shown in the Application before purchase. Prices may vary by region and are charged in Your local currency.

- Payment is charged to Your Apple ID account at confirmation of purchase.

- The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.

- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan.

- If a free trial is offered, any unused part of the trial is forfeited when You purchase a subscription.

- You can manage or cancel Your subscription in Settings > [Your Name] > Subscriptions on Your Device. Deleting the Application does not cancel the subscription.

- You can restore previous purchases using "Restore" inside the Application.

- Refunds are handled by Apple according to Apple's policies.

Term and Termination

This Agreement remains in effect until terminated by You or the Company.

The Company may terminate this Agreement at any time, with or without notice.

This Agreement will terminate immediately if You fail to comply with its terms.

Upon termination, You must delete the Application and all copies from Your Device.

Termination will not limit any of the Company's legal rights or remedies.

Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, agents, and licensors from any claim or demand, including legal fees, arising from:

- Your use of the Application,

- Your violation of this Agreement,

- Your violation of any rights of a third party.

No Warranties

The Application is provided "AS IS" and "AS AVAILABLE" with all faults and without any warranties.

To the maximum extent permitted by law, the Company disclaims all warranties, including but not limited to:

- Merchantability,

- Fitness for a particular purpose,

- Non-infringement,

- Availability and functionality.

The Company does not guarantee that:

- The Application will be error-free or uninterrupted,

- Any defects will be corrected,

- The Application will meet Your needs or expectations,

- Any specific amount of storage will be freed.

If the Application fails to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price (if any) for the Application. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application.

Some jurisdictions do not allow certain warranty exclusions, so they may not apply to You.

Limitation of Liability

To the fullest extent permitted by law, the Company's total liability shall be limited to:

- The amount You paid for the Application or Subscription in the last 12 months, or

- $100 USD, if no purchases were made.

The Company shall not be liable for indirect, incidental, or consequential damages, including:

- Loss of data, photos, videos or contacts,

- Loss of profits,

- Business interruption,

- Privacy or security loss,

even if advised of the possibility.

Some regions do not allow limitation of incidental damages, so this may not apply to You.

Product Claims

The Company, not Apple, is responsible for addressing any claims by You or a third party relating to the Application, including product liability claims, failure to meet legal or regulatory requirements, and consumer protection claims.

Intellectual Property

If a third party claims that the Application infringes their intellectual property rights, the Company, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.

Severability and Waiver

Severability

If any part of this Agreement is found unenforceable, the rest will remain in effect.

Waiver

A failure to enforce a provision does not mean it is waived permanently.

United States Legal Compliance

You represent and warrant that:

- You are not located in a country subject to U.S. embargo laws or designated as "terrorist-supporting",

- You are not listed on any U.S. government restricted party list.

Privacy

Your use of the Application is also governed by our Privacy Policy:

Changes to this Agreement

We may update this Agreement at any time. For significant changes, we will provide at least 30 days' notice before the new terms take effect.

By continuing to use the Application, You accept the updated Agreement.

Governing Law

This Agreement shall be governed by the laws of Gujarat, India, excluding conflict of law rules. You may also be subject to local or international laws depending on Your location.

Entire Agreement

This Agreement is the entire understanding between You and the Company concerning the Application. It supersedes all prior agreements.

You may be subject to additional terms for other services or purchases provided by the Company.
