Mahjong Tide: Terms of Use

These Terms of Use ("Terms") govern your use of Mahjong Tide ("the App"), a tile-matching puzzle game for iPhone and iPad provided by Tilak Beladiya (the "Service Provider", "we", "us").

1. Acceptance of These Terms

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

The App is intended for a general audience. If you are under the age of majority where you live, you may use the App only with the permission of a parent or guardian, who accepts these Terms on your behalf and is responsible for any purchases you make.

3. Licence to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices that you own or control, for your own non-commercial entertainment. This licence is also subject to Apple's Licensed Application End User License Agreement. Where these Terms and Apple's agreement conflict, these Terms apply to the extent allowed.

All rights not expressly granted to you are reserved by the Service Provider.

4. Virtual Items and In-App Purchases

The App contains virtual items such as coins, tools (Hint, Undo, Shuffle, Find Pair, Remove Pair), spin tokens, themes and tile skins ("Virtual Items"). Some can be earned by playing; some can be bought with real money through Apple.

  • Virtual Items have no real-world monetary value and cannot be exchanged for cash, sold, transferred or traded outside the App.
  • When you buy Virtual Items, you receive a limited licence to use them in the App, not ownership of them.
  • All purchases are processed by Apple under Apple's terms. Refunds are handled only by Apple; you can request one at reportaproblem.apple.com.
  • We may change, rebalance or remove Virtual Items, prices and rewards as the game develops.

5. Your Game Progress

Your progress, Virtual Items and settings are stored only on your device. The App does not currently offer accounts or cloud backup. If you delete the App, reset or change your device, your progress and unused Virtual Items may be lost, and we cannot restore them.

6. Advertising

The App is free to play and supported by advertisements provided by Google AdMob, including optional rewarded ads that give in-game rewards. We are not responsible for the content of third-party ads or for any products or services they promote. How ads use your information is explained in our Privacy Policy.

7. Acceptable Use

You agree not to:

  • copy, modify, decompile, reverse-engineer or create derivative works of the App, except where the law expressly allows it
  • use cheats, bots, modified versions, unauthorised software, or exploit bugs to gain Virtual Items or an unfair advantage
  • interfere with or disrupt the App, its advertising or its in-app purchase systems
  • remove or alter any copyright, trademark or other notices
  • use the App for any unlawful purpose or in violation of these Terms

If you find a bug that grants unintended rewards, please report it to us rather than exploit it.

8. Intellectual Property

The App and all of its content, including the game design, levels, tile artwork, graphics, animations, music, sound effects, text and the "Mahjong Tide" name and logo, are owned by or licensed to the Service Provider and protected by copyright, trademark and other laws. "Mahjong" describes the style of the game's tiles; the App is a tile-matching puzzle and is not affiliated with any other mahjong game or publisher.

9. Privacy

Our Privacy Policy explains what information the App and its third-party services (Google Firebase, Google AdMob and Apple) collect and how it is used. By using the App, you agree to that policy.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted operation or freedom from errors. We do not guarantee that the App will always be available, that saved progress will never be lost, or that ads and purchases will always work. Some jurisdictions do not allow certain exclusions, so some of these may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, the Service Provider is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress or Virtual Items, arising from your use of or inability to use the App. Our total liability for any claim relating to the App is limited to the amount you paid for in-app purchases in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You may stop using the App at any time by deleting it. We may suspend or end your access to the App, or to Virtual Items, if you breach these Terms. Sections 4, 8, 10, 11 and 14 continue to apply after termination.

13. Changes to the App and These Terms

We may update, change or discontinue the App or any feature, level or Virtual Item at any time. We may also update these Terms; the new version will be posted on this page with a new "Last updated" date. Continued use of the App after an update means you accept the revised Terms.

14. Apple-Specific Terms

These Terms are between you and the Service Provider only, not with Apple Inc. ("Apple").

  • The Service Provider, not Apple, is solely responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App; Apple has no other warranty obligation regarding the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal or regulatory compliance, consumer protection or intellectual-property claims.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing Law

These Terms are governed by the laws of [India], without regard to conflict-of-law rules. Any dispute will be handled by the courts of [City, State], unless the consumer laws of your country of residence give you the right to bring a claim locally.
